What Is a Caveat Petition?

A plain-language explanation of one of civil law's most powerful protective tools.

A Caveat Petition is filed under Section 148A of the Code of Civil Procedure, 1908. It is a pre-emptive legal notice lodged with a court by a person who apprehends that another party may approach that court to seek an order — often an interim injunction — without giving notice to them.

Once a caveat is registered, the court is legally obligated to serve notice on the Caveator before granting any ex-parte relief to the Expected Applicant. This means you cannot be ambushed by a court order you never had a chance to contest.

A caveat is valid for 90 days from the date of filing. If the anticipated suit is filed within that window, the caveat takes effect automatically.

"A Caveat Petition is your legal advance notice to the court — ensuring you are heard before any order is passed."

Why Should You File a Caveat?

Real-world situations where a Caveat Petition protects your rights.

🏠

Property Dispute

Your co-owner threatens to approach court for partition — file a caveat to ensure you are heard before any order is passed against your interest.

🏢

Business Dispute

A former partner may seek an injunction freezing your business assets without your knowledge. A caveat prevents ex-parte orders.

📜

Family Succession

Anticipating a will challenge? A caveat ensures no ex-parte probate order is passed without your right to be heard.

Frequently Asked Questions

What is a Caveat Petition?
A Caveat Petition is a legal application filed under Section 148A of the Code of Civil Procedure, 1908. It is filed when a person (the 'Caveator') reasonably apprehends that another party is about to file a suit or application before a court that may result in an ex-parte interim order against them. Filing a caveat ensures the court must give the Caveator an opportunity to be heard before passing any order.
How long is a Caveat valid?
Under Section 148A(4) CPC, a caveat shall not remain in force after the expiry of ninety (90) days from the date on which it was lodged, unless the suit or proceedings alleged to be instituted by the Expected Applicant has been commenced before the expiry of the said period.
What happens after I submit the application form?
After you submit the form and complete payment, our advocate drafts your Caveat Petition and may contact you if additional information is required. Once the draft is ready you will be notified. After your approval, the petition is filed in court and you receive the diary number and filing confirmation.
Can I make changes to the draft?
If changes are needed, the status will be updated to 'Revision Requested' and you will be able to update your submission via the portal. Final content decisions rest with the advocate.
Is the information I submit kept confidential?
Yes. All information is protected under attorney-client privilege and our Privacy Policy. Your details are used solely for preparing and filing your Caveat Petition. Data is stored securely with encrypted databases and access-controlled storage.
